1. Agreement to Terms
By accessing or using QuizCast ("the Service"), you agree to be bound by these Terms & Conditions. The Service is operated by QUIZCAST LTD ("we", "our", or "us"). If you do not agree with any part of these terms, you must not use the Service.
2. Description of Service
QuizCast is a software-as-a-service (SaaS) platform that allows users to create, manage, and host live quiz entertainment. Key features include AI-powered voice narration (via third-party integrations like ElevenLabs), real-time scoring, and big-screen TV displays. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. User Accounts
To use most features of the Service, you must create an account via Google OAuth, Phone/SMS authentication, or Email/Password.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate and complete information when registering.
- You are responsible for all activities that occur under your account.
- We reserve the right to terminate accounts that violate these terms or engage in fraudulent activity.
- Your QuizCast account is licensed to a single host. Sharing your login details with others, or using one account to host at multiple venues, is not permitted. If we have reasonable grounds to believe your login details have been shared, we reserve the right to require a password reset and to suspend or cancel your account. If you operate more than one venue, you can add a separate seated login for each from the Team page.
4. Subscriptions and Payments
4.1 Free and Paid Tiers
We offer free use of the Service with limited features and paid subscription tiers ("Home Host", "Venue Pro", and "Studio") which provide advanced functionality, higher limits, and custom features.
4.2 Billing
Paid subscriptions are billed on a recurring basis (monthly or annually). By providing a payment method, you authorise us to charge the applicable fees. All payments are processed via secure third-party processors (e.g. Stripe/RevenueCat).
4.3 Refunds
How a refund works depends on how you subscribed. If you subscribed through the Apple App Store or Google Play, your purchase is governed by their own refund policies — refund requests must be made directly to Apple or Google, not to us, and they decide the outcome. If you subscribed directly with us via our website (Stripe), we generally do not offer refunds once a billing cycle has commenced, except at our discretion or where required by law — for example, if the Service has a fault that we are unable to fix within a reasonable time after you report it to us, UK consumers may be entitled to a full or partial refund under the Consumer Rights Act 2015. UK/EU consumers may also have a statutory right to cancel within 14 days of purchasing a digital subscription; by choosing to access paid features immediately, you agree that this cancellation right ends once we begin supplying that digital content. Nothing in this section limits any right you have under applicable law that cannot be excluded by contract.
5. Intellectual Property Rights
5.1 Our Content
The Service, including its original content, features, functionality, and design elements (excluding user-generated content), are and will remain the exclusive property of QuizCast and its licensors.
5.2 Your Content
You retain all rights to the quiz questions, images, and audio you upload ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and process that content solely for the purpose of providing the Service to you.
6. AI Voice Cloning & Generation
- Our voice features use third-party AI technology (ElevenLabs).
- If you use the voice cloning feature, you represent and warrant that you own or have obtained all necessary rights to the audio samples you provide.
- You may not use the voice generation features to create harmful, defamatory, or deceptive content.
7. Prohibited Conduct
You agree NOT to use the Service to:
- Violate any local, national, or international law.
- Infringe upon the intellectual property rights of others.
- Upload or transmit viruses, malware, or any other malicious code.
- Interfere with the security-related features of the Service.
- Attempt to decompile, reverse engineer, or hack the Service.
8. Limitation of Liability
To the maximum extent permitted by law, QuizCast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from (a) your use of the Service; (b) any unauthorised access to our servers; or (c) any content obtained from the Service.
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Service, including AI-generated content or voice clones.
10. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. We will notify you of any significant changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service constitutes acceptance of the new terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
